Many issues on city council's Wednesday plate

The Arcata City Council will revisit discussion of medical marijuana regulations when it meets Wednesday.

The council is set to introduce an ordinance and hold a public hearing on Arcata Land Use Code amendments related to the marijuana land-use.

The council will also hold a public hearing for a planned development permit, tentative subdivision map and mitigated negative declaration of environmental impact for the Trillium Creek development, located at the end of Ridge Road, and will consider continuing the hearing to Nov. 19.

The Arcata City Council will meet at 6 p.m. in Arcata City Hall.

Public Hearing and Introduction of Ordinance No. 1382 to Amend the Arcata Municipal Code, Title IX, the Land Use Code by Adding Section 9.41.105 - Medical Marijuana: Cultivation and Dispensing as a New Standard for Specific Land Use; and Associated Revisions to: Allowable Land Uses and Permit Requirement Tables 2-1, 2-4, and 2-10; Add Associated Definitions to Article 10 - Glossary; Revise Text to Section 9.42.040 - Accessory Uses, and Section 9.42.090 - Home Occupations. The City Council will also Review Draft Arcata Land Use and Development Guide (LUDG) Amendments, by Adding Chapter IV Medical Marijuana Cultivation and Dispensing as a New Land Use Standard for the Portions of the City within the Coastal Zone.

The City Council began deliberation of the Draft Land Use Standards for medical marijuana on October 1, 2008. The Council requested staff review several items and bring the item back to the Council for introduction of Ordinance No. 1382. In addition, the Council directed staff to prepare amendments to the Arcata Land Use and Development Guide (LUDG) to incorporate specific land use standards for medical marijuana cultivation and dispensing in the Coastal Zone areas of the City. The amendments to the Arcata Land Use and Development Guide (LUDG) are included as Attachment B. Due to time constraints, a thorough review of the proposed LUDG amendments has not been completed at this time. Staff proposes to include a draft ordinance and resolution for the Council to consider at the November 19, 2008, hearing.

RECOMMENDATION: 1) Open the Public Hearing on the Arcata Land Use Code amendments, receive a report from staff and request any clarification from staff regarding the presentation; 2) Open the public comment portion of the meeting to allow members of the public to speak on the Arcata Land Use Code amendments; 3) Close the public comment portion of the meeting and begin City Council deliberations regarding proposed Ordinance No. 1382; 4) Introduce Ordinance No. 1382, waive reading of the text and consent to read by title only; 5) Direct staff to place proposed Ordinance No. 1382 on the November 19, 2008, City Council agenda for adoption; 6) Open the Public Hearing on the Arcata Land Use and Development Guide amendments, receive a report from staff and request any clarification from staff regarding the presentation; 7) Open the public comment portion of the meeting to allow members to speak on the Arcata Land Use and Development Guide amendments; 8) Close public comment portion of the meeting and begin City Council deliberations regarding the proposed draft amendments to the Arcata Land Use and Development Guide; 9) Direct staff to schedule on the November 19, 2008, City Council agenda the introduction of draft Ordinance and Resolution for the proposed amendments to the Arcata Land Use and Development Guide - Article IV.

The City Council reflects that, and so does the array of six candidates running for three seats in the coming election. Many offices focuses its eradication efforts on commercial marijuana operations. Nehring insists that the marijuana was for medical use.
